GENERAL CONDITIONS OF SALE

These General Terms and Conditions of Sale apply to all purchases made on the aziendaagricolamafrica.it

1. CONCLUSION OF THE CONTRACT
 

1.1 The order sent by the customer via the online forms represents an offer addressed to SOCIETA’ AGRICOLA MAFRICA S.a.s. aimed at concluding a sales contract, under the conditions indicated therein as well as in compliance with these General Terms and Conditions of Sale. By transmitting the order form electronically, the customer undertakes to observe said Terms and Conditions in its relations with SOCIETA’ AGRICOLA MAFRICA S.a.s.

Therefore, via the electronic sending of the order form, the customer confirms to know and accept the General Terms and Conditions of Sale and to have received further information that is always available on the website. It is compulsory for the Customer to fill in the personal data. Incomplete orders and/or content containing errors cannot be considered for the purposes indicated in this article.

These general terms and conditions of sale apply in the relationship between the Customer and

2. PRODUCT CHARACTERISTICS AND PRICES
2.1 The characteristics of the products are those presented on the website and described in each product sheet. The images and colours of the products offered for online sale may not, however, correspond to the real ones as a result of any improvements and implementations made in the medium term (of which SOCIETA’ AGRICOLA MAFRICA S.a.s. will in any case give notice on its website) or as a result of the particular Internet browser and monitor used.
3. GENERAL RULES
3.1 All retail prices are inclusive of VAT and all products on our website are actually available at our head office.
The shipment will always be accounted for with a regular accompanying invoice and/or other equivalent document.
To the price of the single product and/or service must be added the cost of each shipment, the amount of which may vary depending on the mode of delivery, the total amount of the purchase, etc. The total amount due for the selected products and/or services will be clearly indicated and communicated to the Customer before the conclusion of the Contract of Sale.
The prices shown on the site, are subject to modifications and/or changes by SOCIETA’ AGRICOLA MAFRICA S.a.s. without any obligation of notice to the customer. These changes may depend on price variations decided upon by the SOCIETA’ AGRICOLA MAFRICA S.a.s. suppliers. For Contracts of Sale concluded before the publication of these changes, but still in progress, the prices in force at the time the order was received will apply.

3.2 These General Terms and Conditions are governed by Italian law, as well as each Contract of Sale, and subject to Italian jurisdiction. Any dispute relating to the General Terms and Conditions or the Contracts of Sale shall be referred to the exclusive competence of the Court of Vibo Valentia, without prejudice to the applicability of the mandatory rules of law for Consumer protection.

4. CASE OF DEFECTIVE GOODS
In the event that the delivered goods are defective:
-the same can be returned to SOCIETA’ AGRICOLA MAFRICA S.A.S. within 15 days of delivery.
-shipping and packaging costs for the return of the shipment are borne by SOCIETA’ AGRICOLA MAFRICA S.A.S.
-the defective goods will be returned or refunded (if they are sold out) by SOCIETA’ AGRICOLA MAFRICA S.A.S.
5. DAMAGED SHIPMENT
If you receive parcels from SOCIETA’ AGRICOLA MAFRICA S.A.S. that are visibly damaged by the courier, (broken packages or packages visibly stained by the leakage from any bottles or other broken containers) you can do as follows:

-If there is more than one affected package, reject the sender’s damaged packages by signing the courier note “With Reservation” specifying the reason. We will then take care of returning the damaged packages and sending them back to you.
If, on the other hand, there is only one affected package, reject the sender’s shipment and, as in the previous case, we will take care of the return and new shipment.
Any shipping costs for returning the damaged package to the sender and receiving the new one are fully borne by us.
In case of the broken product being out of stock, you will be contacted about a possible replacement; if you do not find any suitable replacement product, SOCIETA’ AGRICOLA MAFRICA S.A.S. will refund the amount paid.

6. RIGHT OF WITHDRAWAL

6.1 Purchases on the aziendaagricolamafrica.it website are subject to the rules of Legislative Decree 206/2005 and Legislative Decree 21/2014, which guarantee the right to withdraw from the purchase contract for any reason.
The following are the conditions for exercising the right of withdrawal:

-to exercise the right of withdrawal, the goods purchased must be substantially intact
-the right of withdrawal is reserved only to natural persons. Purchases made by retailers or by persons who, for whatever reason, purchase for resale to third parties are therefore excluded.
-upon receipt, the goods will be examined to assess any damage or tampering, so it is recommended to take the utmost care in preparing the package using the original packaging or similar packaging.
-to exercise this right, the customer must send us a notice indicating the intention to withdraw from the purchase made, within 15 days from the date of receiving the goods ordered and must send us the goods within a further 15 days.
-the shipping costs are to be borne by the customer

6.2 Procedure for withdrawal
You must send an e-mail to info@oliomafrica.com containing the declaration of intent to exercise the right of withdrawal, indicating all the information requested:

-order number and date of order
-invoice number
-the list of products subject to withdrawal (identifying each item with the article code)
-Your bank details (IBAN code)

Next, we have to wait for a communication from our Customer Service authorising the return.
Upon receipt of such notification, you must return the goods subject to withdrawal within a further 15 days to:
